Safe, respectful & inclusive workplaces – a new positive duty
The problem
Everyone has the right to feel safe and respected when they are at work. Despite this, 1 in 3 people have been sexually harassed at work. Sexual harassment in Australian workplaces is pervasive: no industry or business is immune. Even if your organisation receives no or few complaints, that does not mean harmful behavior is not occurring. In fact, a lack of reporting could be a red flag—it can indicate a culture where workers feel uncomfortable reporting incidents or raising concerns. This is why we advocate for stronger workplace psychological safety and proactive prevention strategies.
A new positive duty
Since December 2022, most businesses and organisations, regardless of size, in Australia have had a positive duty to eliminate sexual harassment and sex discrimination under the Sex Discrimination Act 1984 (Cth). From 12 December 2023, the Australian Human Rights Commission will commence monitoring compliance and enforcing the positive duty.
The law requires that employers and PCBUs take reasonable and proportionate measures to eliminate the following unlawful behaviours under the Sex Discrimination Act:
sexual harassment
sex discrimination
sex-based harassment
hostile work environments
victimisation
This represents a seismic shift towards proactive action to prevent harmful behaviors in the workplace — rather than reacting after harm has already occurred.
Beyond legislative compliance, we believe the positive duty is an opportunity for businesses to strengthen their systems, policies and practices through Respect at Work training and other support mechanisms. It’s a chance to foster a workplace culture where everyone thrives. However, we also recognize that, for many workplaces, the implications of the positive duty may feel daunting. The potential for change is invaluable, but seizing the opportunity is no small task.

The Elevate team are leading national experts on the positive duty to eliminate sexual harassment and sex discrimination in Australian workplaces. We were involved in the development of the positive duty from inception, through to leading the creation of the Australian Human Rights Commission’s guidance materials. Our founder also established the compliance and enforcement team at the Commission. This deep, hands-on experience gives us a unique and sophisticated understanding of the effective Positive Duty Compliance Support measures that businesses and organisations can implement.
